Montgomery and Berks County Debtor’s Rights and Bankruptcy Lawyer
Are you being sued on a credit card or other debt?
If you have been sued in court on a credit card or other debt, please contact us right away, as you are most likely on a deadline to respond. While you may feel that you have no options, there may be more than you think. Your creditors have the burden of proving that you owe them money, and that is not always easy to do. Many of the banks or credit card companies who file suit, do not have the witnesses or necessary paperwork to prove their cases. At Dolan Ray Law, LLC, our experienced attorneys know how to determine and exploit these weaknesses to achieve the best possible result for our clients. In some cases we may be able to have the lawsuit dismissed outright.
Are you being harassed by rude or abusive debt collectors?
Sometimes debt collectors cross the line by using abusive language, using unscrupulous tactics or making false statements in their attempts to collect a debt. There are laws in place to shield people from this behavior. The Fair Debt Collection Practices Act (FDCPA) is one such law. It was enacted by Congress in 1977 in response to abusive consumer collection practices. The FDCPA is a “strict liability” statute, which means that if a collector is found to have violated it, the aggrieved consumer is entitled to a statutory penalty of $1,000.00, without having to prove that he or she actually was damaged in that amount. The FDCPA also provides for an award of reasonable attorneys fees incurred in a suit against the collector. Violations of the FDCPA include, but are not limited to, calling at inconvenient times (defined as before 8:00 AM or after 9:00 PM), continuing to contact the consumer after having been told not to, or making false claims. If you believe that a debt collector has acted in a manner that violates the FDCPA, please contact Dolan Ray Law, LLC. Our debtors’ rights team will help you to navigate this complex law, and determine whether you might be subject to its protections.
